They're offering me financing, which I repeatedly tell them I don't need as I am already approved with TD auto finance. I tell them I am just looking. Now I have an excellent credit rating, and I keep a close eye on it. I monitor it regularly. Next thing I get another call from Janex auto sales telling me that I'm pre approved for a 2023 Toyota Tacoma. I said did you go into my credit file. Oh no we would never do that . Next thing I get an alert from Equifax that there has been a hard inquiry on my file. And wouldn't you know... Janex auto sales. I contacted the credit bureau, and my lawyer, and finally Janex auto sales. I asked why they accessed my file they said I applied, I said no I didn't, I don't need their over inflated credit, I am in good standing with my bank. I told them to stay out of my credit file and remove my name from their list. At which point the credit manager Mustafa became somewhat belligerent, because they had sent me several vehicle options and I didn't reply.. At which point I again advised him to remove my name from their list, do not run my credit again or you will be hearing from my lawyer. Alas no I didn't purchase a vehicle from them. And no I won't be purchasing a vehicle from them. And I had best not see any more activity on my credit bureau from them. I regret buying a used 2012 Kia Sorento from Janex in August 2021. It seemed like a good deal at $10,000 with 128,000 km, but it turned out to be a lemon. Here is a list of the $5,619 repairs I had to do. - $1,517 (Oct 5, 2021): Antenna, driver’s seat trim and cover, all season tires - $700 (Oct 2021): Rust removal work - $305 (Dec 13, 2021): New battery - $247 (Jan 13, 2022): Repaired three rear sensors that had been glued in - $1,051 (May 10, 2022): General repairs to brakes, and replaced front pads due to corrosion - $500 (Feb 23, 2023): Oil leak from oil pressure sensor - $283 (May 16, 2023): Check engine light on, large evap leak in vent circuit - $1,026 (Oct 19, 2023): Replaced both front quick struts, rear right toe adjustor being seized To make the SUV certified safe to sell second-hand, it would require me to spend thousands more dollars in repairs to fix: Hole in frame on pass rear Right rear tail light bulb Right side headlight lens Free up front caliper sliders Replace park brake shoes, hold down kit and actuator lever Replace rear brake backing plates and rear right caliper Fix oil leaks from engine/transmission area Rear differential is leaking Front brake service as caliper sliders are seized Rear brake pads, rotors, right rear caliper Replace rear CV axle shaft seals as they are leaking Condenser fins are gone This experience has overall cost me a lot of money and stress. I absolutely DO NOT recommend purchasing a vehicle from Janex. I did some research prior to purchasing, and read that Janex was rated one of the top 3 used car dealerships in Ottawa – what could possibly Janex. I purchased a vehicle and took delivery in mid April. Today, 3.5 months later, the issues are ongoing, this entire experience has been a nightmare. I have given them more than enough time to fulfill their end of the contractual obligations, but still continue to pursue them in back and forth follow-up, and it is received with lies, stalling, and at times, non responsive. It is a long read, but, this is what you are in for if you choose to purchase your vehicle from Janex. - April 14th – visited Janex website to look for a vehicle. Found one that fit my budget – I proceeded to obtain a trade in estimate – returned a result of $5,700. I received a call within 30 minutes from a sales associate that asked me to come in and see what we can work out. o During the visit, was told that the car I was looking at would not be a good option for me, as they would not be able to finance it for more than 2 years, which was significantly out of my budget. o I was VERY clear on the bi-weekly payment amount, and the sales associate said he can make something work for me. He then showed me a car that would fit within my budget, $65 more bi-weekly than what I was currently paying – it would be a stretch, but, I could make that work. o Sales associate conducted a credit check before asking my permission, and when I asked why he said “to see what we are working with”. I am very cautions with my credit rating and have worked very hard to repair it and keep it in “good” range after a bankruptcy as a result of a divorce. I commented “well I guess I’m obligated to buy a vehicle from here now”, to which he just shrugged and smiled. o Took the car out for a test drive and noticed that the brakes were pulsing and the alignment was pulling to the left – mentioned this to the sales associate and he confirmed that it would be taken care of when it went in for the safety inspection. Was shown (not given) a copy of a CarFax report showing “no accidents” o Was promised winter tires on rims as a part of the deal, however, noticed that there was a cost associated with them on the sales agreement and was told “I have to put that there to get them ordered, don’t worry, it won’t show on the final sales agreement” (my trade in had new winter tires on rims included) o The amount of my trade in was not included, and when I questioned it was told ‘don’t worry, it will all be there” I asked if the amount I was given on the website of $5,700 was what they were going to give me I was told “yep, it’s all good, it will all be there”. - April 16th – Signing the final sales agreement, the sales associate tried to speed through the banking agreement, skipping pages and pointed to the last page where I was to initial. I asked to read the document, and glanced over it quickly. At this point I was flustered with all of the additional fees that I was charged, I signed without asking any questions. I was in shock. I was charged additional fees that were not on the initial sales agreement: o $3,599 warranty – was told the bank required it or the deal would be cancelled and I would lose my deposit o $999 financing fee – was told this was charged by the bank, but it was not, this is a Janex fee (and according to the Motor Vehicle Act, is to be included in the sale price of the vehicle) o Monthly payments were going to be $68 more biweekly o Gave me $1,200 less for my trade in than originally agreed upon o $899 for winter tires and rims (I told the sales associate that I was very disappointed as this was supposed to be included, he shrugged – I did not argue, because I would have had to buy them regardless) o Total of $5,497 in additional fees PLUS taxes on top of that, that were NOT included in the original sales agreement - April 18th – Delivery of vehicle - tires were not with the vehicle when I picked up, was told they would be available “tomorrow”. They were not able to do the licensing, so I was given a copy of their ownership to take with me in the event that I was pulled over. Just before I got into the car, the sales associate said “we’ve got new brakes on there for you too”…this turned out to be a complete lie. - Brought the car home, my son noticed a badly damaged rim, cracked and a scraped bumper. I noticed the scratches initially, but chalked it up to rubbing against a curb. - April 19th – texted sales associate to see when my ownership would be ready for pickup, and also confirm that the tires would be there – he responded with a pickup time, but evaded the tires question. When I picked up the ownership, I inquired about the tires and was told again “tomorrow” - May 3rd Decided to bring it to my mechanic (would have been earlier but his shop was closed for 14 days because of a covid outbreak) after I noticed a grinding noise coming from the back. Before he even started the inspection he asked me “did you know this car has been in an accident?” I was shocked when he showed me everything. o I paid my mechanic $135.60 for a full diagnostic where the following discrepancies were discovered:  Light brake pulsation at high speed  E-brake could use adjustment  Front right headlight, fender misaligned  Front right bumper not clipped in properly  Front right lower bumper damage  Front right inner fender and duct loose and missing clips  Front right bottom of passenger door touching fender  Suspect front right accident due to fender, headlight and front right control arm within the last 6 months  Both sides front doors – undercover broken tab and missing clips, been repaired and broken again  Coolant seeping from heater hoses  Front right rim damaged badly  Light pull to the left (alignment) o My mechanic indicated that this vehicle should not have passed a safety inspection in the current condition, and that I should contact the dealership to cancel the contract o Obtained a CarFax report at my own expense, car had 1 previous owner and listed the dealership where all of the maintenance was conducted. I contacted the dealership and they provided me with a 3 page service report document. The report disclosed:  October 14, 2021 - Craquage de suspension avant, lumiere a brume droit ambue (cracked front suspension, right fog light), amongst many other issues with the vehicle o Wrote an email to Janex with all of this information and requested that the contract be cancelled. - May 10th – received a response from Janex asking me to bring the vehicle in for their mechanics to look at it - May 18th – visited Janex Service to have the car looked at. Service manager agreed with all items listed in my mechanic’s report - May 19th – Sales associate contacted me by email to ask me what the outcome was from their Service department, this shocked me as I would have thought they would have been in communication with one another. I advised of the findings. He replied with an offer of $500 and a year of oil changes. I advised that I would require some time to review and consider their offer. - May 30th – I replied with a counter offer for them to fix the items listed in my mechanic’s report, as well as a refund of the $999 financing fee, a full refund of $899 plus taxes for the tires that had still not been delivered to me, and $5,000 refund on the sale price. - June 6th – reply received from Janex agreeing to fix the discrepancies, $1,500 compensation and tires when I pick up the car after the repairs are done. I advised them at that time that I would be out of the city beginning June 13th, and would appreciate if the work could be taken care of during that time. I was advised that the Service manager would “be happy to take care of this for you in your timeline” - June 7th – Sales associate advised me to contact the Service manager to set up a date and time, so I did that. - June 8th – Followed up with Service manager to set up a date and time, and reminded him that I was leaving on Monday for 2 weeks. - June 9th – followed up again with Service manager to set up a date and time, and requested the $1,500 compensation be deposited to my account by end of next business day. - June 13th – followed up, again, with Sales associate and Service manager, advising them that 7 calendar days had passed and I had not yet had a response regarding the repairs or the deposit to my account. I requested a reply by end of day July 17th, otherwise, I would draw the conclusion that Janex had no intention of making good on our agreement and would proceed with the process of cancelling the contract. - June 20th – received communication from Sales associate asking me to let them know when I have returned so that they can perform the work. - June 27th – replied advising them I had returned. Also indicated how disappointed I was at how this transaction has unfolded and that I am lacking confidence in the word of Janex. I offered a final opportunity to make good on their promises. I was asked if I had contacted Service to set up a date and time, and advised that I had sent 4 emails on June 7, 8, 9 and 13, and received no reply. The Service manager was cc’d on this communication. Was contacted and asked to drop it off Wednesday night or Thursday morning. Sales associate advised me that the funds would be transferred to me after the work is performed to my satisfaction. - June 28th – Sales associate confirmed I could drop off the car on Wednesday night, and provided me with his cell number “If you need a drive or run into any issues please call me at ###-###-#### here to help” I was told the work would take the day to complete. - June 29th – dropped the vehicle off at 5:30pm and left keys with a mechanic - June 30th – emailed Sales associate and Service manager at 4:01pm looking for an update. o Sent a text to Sales associate at 5:10pm (service closes at 5:30pm) asking when I can pick up my car, received a reply back “sorry not at work today please call service”. I requested to have him have someone call me with an update. At 5:37pm (shop closes at 5:30pm – and this was the Canada Day long weekend), and was advised that “they have most of the stuff completed. If you wish to have it for the weekend they can complete everything and finish next week”. At this point, it would have taken me 30 minutes to get to the service department location, and, I was on my way to dinner with my family, indicated that I would have no choice but to leave it there for the next 4 days and hope to get it back on Tuesday (July 5th). Sales associate said he felt bad and offered me his personal vehicle. - July 5th – received a text from the sales associate at 5:44pm that the work had been completed and it was ready for pickup. As their service department had already closed so I had no choice but to pick it up the following day. I was without my vehicle for 6 days for a job that I was told would take 1 day. - July 6th – picked up the vehicle, work seemed to be good, mechanic came out and went over everything – I asked if my tires were in the car and he looked confused. He indicated that he wasn’t aware of tires with this car, that they had just received a shipment, but wasn’t sure which ones would be mine. I asked to speak to the Service manager, but was advised that he was out of the country. I advised that I would follow up with the Sales associated. o Sent the Sales associate a text message indicated that I was satisfied with the work and to please confirm when the funds would be deposited to my account. He replied asking me if I could send an email to the Service manager and cc him confirming the work was performed to my satisfaction and that I received the tires. I replied advising that the Service manager was out of the country (he would have known this) and that the tires weren’t there. At this point my patience has run out, that I would require the funds by close of business the next day and that I would deal with the tires separately. The response I received was that the funds would not be given to me until the tires were received, that he has to follow the rules and guidelines that have been given to him, and that I should follow up with the Service manager when he returns from vacation. This is in complete contradiction to his email of June 27th. - July 25th – Text chain as follows: o 12:17pm – (me) Good afternoon Nic. I can confirm that I am satisfied with the repairs, I have received the winter tires and rims, and all that remains outstanding is the payment of $1500 to me as compensation for the issues that I have encountered since purchasing this vehicle. Unfortunately, all I am met with is excuses and sadly, lies, as to why the funds have not been transferred to my account. Most recently, the reason the funds were not paid to me is due to your Service manager being out of the country, and the product had not been ordered, and that he was the one that authorized the compensation of $1500. This was quite a surprise, as they were to have been purchased at the time that I purchased the vehicle, and provided to me when I took possession of the vehicle on April 18th, however, they were not. I was then told that they would be with my vehicle when the repairs that should have been completed during the safety and prior to selling to me, were finally completed on July 6th, however, they were not. I was exceptionally disappointed, as Janex had possession of my vehicle for 6 days over the Canada Day long weekend (when I was told the repairs would only take 1 day), and there was significant time to ensure that the tires were there. I was then advised by Nick to contact Jan when he is back in the country to arrange for my tires. On Monday, July 26th, I contacted Nick for an update on my tires and was advised that Jan was still out of the country and was due back next week, however, Nick was working on getting the tires. I was advised on Tuesday, July 26th that my tires and rims were available, and I retrieved them the following day, July 27th - to my surprise, Jan, who was apparently 'out of the country until next week' was there, and assisted in loading the tires into the back of my fiancé's truck. After nearly 4 months, I am still awaiting compensation of $1500. This amount was to be paid to me upon satisfactory completion of the repairs, which has now been completed. Mr. Zahariev, please provide me with an explanation as to why these funds are still outstanding, why there have been so many unnecessary delays, and why.
