Hi alland The vehicle was well known to the dealership, as the original owner is a long time client, who had recently switched to Audi. The vehicle spent its entire ownership indoors, other than when driving. The Original owner maintained the vehicle in their garage at home, and had an underground parking spot while at work. When we received the vehicle on trade, it was stored indoors in our underground parkade, and later transferred to the showroom. The only mileage we added was that of incidental transport and quality checks after inspection. The vehicle passed our safety inspection, including from some replacement of brake pads, rear tires and a service. As required (and copy/pasted here) by the Vehicle Sales Authority of BC: Licensed dealers must sell vehicles in a clear and transparent manner - We assured the client it had passed safety and was ready for sale. Dealers must stand behind the representations they make about a vehicle - We were clear on vehicle specifics and claim history, the vehicle passed safety and did not exhibit any issues with moisture in headlamps. We do not test for massage seat functions in a provincial safety. The customer did not request we test the massage seat function. Dealers must not withhold or provide information that would cause you to make an error in judgment about whether or not to buy the vehicle - No information was withheld Dealers must meet strict standards, including certain declarations and disclosures - All declarations were disclosed Dealers must declare if a vehicle has been registered out of province - The car was only registered to one owner in British Columbia. Dealers must declare if a vehicle was used as a lease, rental, taxi or emergency vehicle - None of these declarations apply Dealers must declare prior damage over certain limits - All declarations were made on Vehicle History - Carfax provided. Dealers must guarantee that their vehicles are free of liens - Car was free of Liens Dealers must comply with strict standards when leasing a vehicle - n/a Dealers must offer used vehicles that meet minimum safety requirements, or Dealers must declare vehicles as Not Suitable for Transportation and be towed from the dealership - This used vehicle met or exceeded all minimum safety requirements. ​ We certainly regret any inconvenience associated with the items experienced, however we cannot provide unlimited recourse for product quality. A vehicle warranty was declined, and would provide financial assurance for future repairs. It has been determined there is a service action from Mercedes-Benz Canada regarding moisture in the headlamps, but this must be dealt with Mercedes-Benz Canada.

It seems we disagree. Under the law in BC, a level of quality, performance and durability is implied into every sales contract. When you buy a car from a dealer, it has to be: • fit for the purpose you bought it for • of “merchantable” quality • durable for a reasonable period of time • “as described” Ignorance of the leaking headlights and other faults does not change the fact that you sold a car with significant deficiencies (over $8000 worth) that you are refusing to address. The car was described as in showroom condition with no repairs required. This was not the case. Your note seems to imply that I should have purchased an extended warranty with the car. As pre-existing issues are not covered by any extended warranties, this would have simply put more money in your pockets and would have done nothing to help with my current situation. And finally, there is no factory recall on the headlights. None of these repairs are covered by Mercedes. This is explained in the note you received from the O’Regans Mercedes service manager who sent you a quote for the repairs on October 17th.
